Professor Ernst Publishes 2014-2015 Update to Patents Chapter in Business Litigation Treatise

In 2011, Professor Samuel Ernst first co-authored (with The Honorable Timothy B. Dyk of the U.S. Court of Appeals for the Federal Circuit) the Chapter on Patents in the leading treatise BUSINESS AND COMMERCIAL LITIGATION IN FEDERAL COURTS (now in its third edition). For the past three years, Professor Ernst and Judge Dyk have completed an annual supplement to their section of the treatise. The 2014-2015 Supplement has just been published. The supplement provides a complete update to developments in the patent law occurring in the last year and recommends litigation strategies in light of these developments. Among other things, the Chapter 86 Supplement adds a discussion of the America Invests Act, the first major patent law bill since the Patent Act of 1952. The Supplement also covers the Supreme Court’s recent major decisions in such areas as patent eligible subject matter, enhanced damages, and subject matter jurisdiction in patent related cases; and provides complete coverage of major developments in the Federal Circuit. Samuel Ernst
is an assistant professor of law at Chapman University Dale E. Fowler School of Law where he teaches in the areas of intellectual property, contracts, and civil litigation practice. His scholarship focuses on patent law. Prior to joining the Fowler School of Law in 2013, Professor Ernst was a partner at the international law firm of Covington & Burling in San Francisco, practicing intellectual property, commercial, and appellate litigation, while maintaining an active pro bono practice focusing on veterans disability recovery and homeless advocacy. He earned his J.D. Magna Cum Laude from Georgetown University Law Center. He has a B.A. in Modern Literary Studies from U.C. Santa Cruz and an M.A. in Comparative Literature from U.C.L.A.
